Apartment Handover in Switzerland: Checklist & Your Rights

The Wohnungsübergabe determines whether you get your deposit back. Use this checklist to be prepared — and know what you need to sign and what you do not.

The 5 Golden Rules

Filing an Objection: 10-Day Deadline

If you discover discrepancies after the handover, you have 10 days to submit a written objection via registered mail to the property management.

Tip: Note any reservations directly on the protocol before signing. This is legally stronger than a later objection.

Deposit: When Is It Released?

The landlord may only withhold the deposit (Mietkaution) if there are legitimate claims — such as for damage or unpaid rent.

Without your consent or a court decision, the bank cannot release the deposit. If the landlord does not file a lawsuit within one year, the deposit is automatically released.

Do I have to sign the protocol immediately?

No. You are not obligated to sign the protocol on the spot. If you disagree with any points, refuse to sign or add handwritten reservations.

What counts as normal wear and tear?

Normal wear (e.g., light scratches on parquet, faded wall paint) is covered by your rent and does not need to be compensated. Damage from improper use does.

How long do I have to object?

You have 10 days to submit a written objection via registered mail if you discover discrepancies after the handover.

When do I get my deposit back?

What is kleiner Unterhalt (minor maintenance)?
